A PUBLICAN who failed to stop a sex romp has been banned from holding a liquor licence for five years after initially being banned for a decade.

Liquor authorities disqualified Albion Hotel owner Allan Francis Ogilvie from holding a licence for 10 years after seven offences in April and May, 2014.
Two men and the woman, then aged 30, had sex in the smoking area, with most of the antics captured by security cameras.
Footage showed her lifting her top and exposing her breasts during the incident, with Ogilvie and five other men present.
One of the men took photographs.
Ogilvie had also supplied alcohol outside of trading hours, with further offences for supplying liquor to an intoxicated person and allowing a drunk person to remain on premises.
The Independent Liquor and Gaming Authority imposed a decade-long ban in November last year, which was recently appealed in the NSW Civil and Administrative Tribunal.
Office of Liquor, Gaming and Racing acting compliance director Anthony Keon had argued there was a need for the venue to meet community expectations.
“The pattern, frequency and seriousness of offending indicates the risk of alcohol-related harm to the community is too great should Mr Ogilvie be permitted to continue managing a licensed premises,” he said.
“It is alarming that seven offences of such seriousness were committed less than 12 months after Mr Ogilvie became the licensee.”
Ogilive had argued on appeal through lawyer Rod Pogson that the matter had already been dealt with in court.
He said the penalties were “harsh” and said further penalties would be “unacceptably harsh”, and noted that there had been no further incidents in the following 18 months.
The bar now closes at 9pm, younger patrons tend to go to other venues and poor behaviour is discouraged.
“The Albion is not only a pub, it is Allan Ogilivie’s home,” Mr Pogson said.
“(It) has been for the past eight years.”
The ban now expires at the end of 2020.
