Gerald Alfred Davis, 61, of Golconda, was travelling to Spreyton in July 2019 when he was intercepted at 5.54am by the National Heavy Vehicle Authority while carrying two tractors on his truck.

Magistrate Sharon Cure, in the Launceston Magistrates Court on Wednesday, heard the width of two tractors on Davis' truck were in contravention of requirement and presented a "fairly significant public risk".

The court heard the only way for the load to be compliant was if Davis had been approved for a permit, had a pilot car alerting other motorists to the "public risk", and had amber flashing lights on the outside of the tractors. He had not employed any of those mitigation factors when he was pulled over on Gilbert Street at Latrobe.

The court also heard Gilbert Street was an unapproved road.

The tractors were 10 centimetres outside of the legal requirements and were hanging 5 centimetres over either side of the truck.

Ms Cure said the previous offence, when Davis was disqualified from driving in 2015, had been a "well known tragedy".

The incident resulted in the death of a couple who were out on a Sunday motorbike ride on Lilydale Road at Lilydale.

"It was an incredible tragedy in the Launceston area," defence counsel Darrell Grey said.

Ms Cure said despite the fact the "tragedy" had occurred six years ago there was "no excuse to further offending".

"[Davis] needs to be deterred from taking any sort of risk," she said.

"[Davis] well knows what it can amount to."

The court heard Davis had committed about 12 other prior infringements including one in 2017 for contravening mass or dimension restrictions.

Ms Cure delivered Davis a $5000 fine and said a "specific deterrence ... has to loom large".
