At the start of question time on Tuesday, Mr O'Byrne explained his decision to quit the Labor party caucus but remain sitting as a Labor member for the duration of the term of parliament.

He provided detail about the specific complaint from his time as head of the Liquor, Hospitality and Miscellaneous Union - that he "exchanged kisses" with employee Rachel Midson, then 22, in a taxi after a work function at a Hobart nightclub, and then "exchanged text messages" for several months.

Ms Midson's confidential complaint was subject of an independent report by former senior member of the Fair Work Commission bench, Barbara Deegan, but the full report was not released to Mr O'Byrne or Ms Midson.

Last week, Ms Midson spoke of her concern about the process.

Mr O'Byrne said he understood her position, and called on Labor to release the report to provide clarity.

"For as long as the report remains confidential, many in the Tasmanian community will doubt that the Labor Party is serious about the robust investigation of allegations of sexual harassment and victimisation, and many will have uninformed doubts about its findings," he said.

"I do urge the Labor party to release this report, or to the very least, provide a copy to the complainant and defendant.

"While the Deegan report found that I did not engage in the sexual harassment and victimisation of Ms Midson some 14 years ago, I do not claim it has absolved me of inappropriate workplace behaviour.

"I took responsibility for my behaviour by resigning the Labor Party leadership and apologising to Ms Midson knowing I would suffer serious reputational damage even if the investigation found I had not engaged in sexual harassment and victimisation."

Mr O'Byrne took a seat behind the Greens when Parliament returned on Tuesday. His position as, effectively, an "independent Labor MP" was not dissimilar to former speaker Sue Hickey's position with the Liberal Party.

Mr O'Byrne said men should pay attention to the public debate around his conduct.

"I hope my experience will give men a salutary reminder that the implications of power imbalance for consent between men and women must be properly weighed in any social and workplace setting, in any instance men must play a proportionate price for failing to respect the rights of women," he said.

Labor leader Rebecca White called on Mr O'Byrne to resign from parliament on Sunday, and again on Monday, during caucus meetings.
