The foundation's legal representative Ron Merkel said further surveys this month had identified swift parrot habitat for foraging and breeding within coupes in the Eastern Tiers.

There are about 20 coupes that the foundation would like the injunction to include.

Mr Merkel said material provided by Sustainable Timber Tasmania indicated logging operations would not be carried out in these coupes over the summer.

But he said the forestry company had not indicated that logging would not go ahead either.

Legal representative for STT, Shaun McElwaine, said there were only three coupes that have certified forest practices plans in the area.

"In each of those two contestable coupes, there are exclusion areas that have been mapped for what i'll call the old growth trees - that is, the trees that on all of the evidence are the likely nesting sites for swift parrots," he said.

Justice Duncan Kerr adjourned the court for an injunction hearing on January 11.

Bob Brown was last week arrested twice during protest action which targeted the three contested coupes in the Eastern Tiers.

Sustainable Timber Tasmania in September agreed not to log 19 coupes which contained swift parrot habitat.

An Australian National University study released this month claimed the swift parrot was heading towards extinction.
