Veolia lodged a development application to build a recycling centre at 19-25 Churchill Park Drive, the former Humes concrete manufacturing site, but it was rejected by the council in September.

A full hearing to appeal the decision is scheduled for December 8 and 9 with the Resource Management and Planning Appeal Tribunal.
Two grounds for appeal will be argued, including that it met emissions impacting sensitive uses and attenuation distance requirements.
The council rejected it based on two reasons surrounding noise emissions. The first referred to trucks starting and leaving the site early in the morning, causing an adverse impact.
The second was because the DA did not demonstrate there would be no environmental nuisance.

Before the decision by the council, an independent consultant had assessed the DA and recommended it for approval subject to 50 conditions ranging from usages to start times to noise and waste storage.
Fifty-eight public representations, a petition with 384 signatures and 17 people, who spoke against the development at the council's meeting, all opposed the development.
The site is zoned as light industrial and the proposed usage was discretionary under the planning scheme. This meant it was up to the council to deem it an appropriate use of the site or not.
The RMPAT hearings will take place from 10am on December 8-9.
