A 39-YEAR-OLD man who did not realise he was driving an alleged armed robber to the crime scene avoided jail after agreeing to give evidence in an upcoming trial.

Scott Deane Radin, of East Launceston, was convicted of being an accessory after the fact of armed robbery, making a false statutory declaration and being in possession of stolen property.
Justice Robert Pearce said that if not for Radin's agreement to give evidence he would have received a total of six months jail with four months suspended.

Instead, Justice Pearce imposed a three month wholly suspended prison sentence, an 18 month Community Correction Order and 70 hours of community service and a $300 fine.
Radin drove his friend Nadine Bryan and a man from the Village Motor Inn to the Morty's Complex in Wellington Street about 10.30pm on December 6.
The man, who can't be named for legal reasons, had a .22 firearm and robbed the BP service station of $650 cash and cigarettes.
Radin drove the man back to the Village Motor Inn and was given four packets of cigarettes and the next day made a false statutory declaration to police.
