Former Lambie staffer Fern Messenger sought the order, claiming an email sent by the Burnie-based Senator in January caused her a mental injury.

In the Burnie magistrates court on Monday, Senator Lambie's counsel, Glynn Williams, argued the matter was an abuse of process aimed at humiliating and degrading Senator Lambie.

"The proceedings today are effectively a public circus," Mr Williams told Magistrate Tamara Jago.

He said he received an email from Ms Messenger on Sunday night that revealed the "real objective" of the proceedings.

Mr Williams said that was to "cause as much public embarrassment to my client as can possibly be done".

He suggested the "proper course" would be for the application to be dismissed.

Ms Messenger, representing herself, sought to present medical documentation as evidence.

Ms Jago said she would not accept it without a medical expert being present who could be cross-examined about it.

She said it was a matter of natural justice that if something was to be asserted, the other side should have the opportunity to challenge it.

Ms Jago asked how Ms Messenger intended the prove her assertions if she was not going to put evidence before the court in an admissible way.

"You aren't the author of the documents," Ms Jago said.

"The doctor is."

Ms Jago asked if Ms Messenger had the doctor available to give evidence.

Ms Messenger said she did not.

Ms Jago then asked how Ms Messenger meant to establish she had received an injury from the email, and ordered that if Ms Messenger wanted to rely on a medical report that she make a qualified person with medical expertise available to be cross-examined.

Ms Messenger said she could speak to a psychiatrist.

Ms Jago said Ms Messenger would need to bring her application before the court in a proper form, and it sounded like she was not in a position to advance the matter.

Ms Messenger broke down, and was consoled by her husband, Rob, another former Lambie staffer.

Ms Jago asked Ms Messenger to use the lunch break to reflect, and to come back with as proposal for how she intended to proceed.

She also ordered two police officers Ms Messenger had intended to call as witnesses be allowed to leave the court and return to their duties, to be contacted if needed.

"The community can make much better use of their services," Ms Jago said.

After lunch, Ms Messenger told Ms Jago she apologised for being emotional and that Mr Williams had "confronted" her before the proceedings.

"You're in a court of law," Ms Jago said.

The magistrate said there were rules of evidence, behaviour and etiquette and she would not allow Ms Messenger to "make speeches".

Ms Messenger apologised, and said the email was intimidating and bullying.

She said if the email was not sent she would not be seeking a restraining order.

Ms Jago adjourned the matter until July 31.

She said she would rule then on Mr Williams' application to dismiss the matter as an abuse of process.

Ms Jago said she would allocate a hearing date if the matter was "still standing" after the ruling.

Senator Lambie was present in the court via an electronic link.

The matter related to an email Senator Lambie allegedly sent to Ms Messenger on the night of January 29.

In February, Chief Magistrate Catherine Geason set a date for mediation of the matter.

It followed Ms Messenger applying for a restraining order against Senator Lambie.

During the February court appearance, Mr Williams argued the application should be dismissed because it did not meet the legal standard.

He said most of the application had no facts and suggested it was an attempt to "bring down" Senator Lambie's character.

Ms Messenger told the court the "unsolicited email" had caused her injury and was a veiled threat to her and to family members.

Mr Williams produced a letter in which Senator Lambie undertook not to approach Ms Messenger in any way.

The Messengers and Senator Lambie are also involved in a Federal Court matter.

The Messengers are taking action against Senator Lambie and the federal government, alleging they were unlawfully dismissed from Senator Lambie's employment in 2017.
