Ryan Keith Nichols, 38, pleaded guilty to one count of being the driver of a vehicle holding a driver's licence which required that no alcohol be present in his body.
IN OTHER NEWS:
Defence counsel Grant Tucker told the court the man was wrung out after a visit to his father in St Helens and had stopped for a couple of beers on his way home.
He recorded a reading of .028 after being stopped for a random breath test on Lilydale Road.
"His record under the Road Safety Alcohols and Drugs Act is rubbish... but I submit that this can be dealt without a period of imprisonment," he said.
Magistrate Ken Stanton said Nichols was a persistent offender.
"On my calculation this is your 15th offence under the Act with five alcohol offences, four with drugs in your body and five occasions of driving while disqualified," he said.
"I accept that you were emotionally wrung out but the message has been given to you multiple times.
"Stopping at the Perth hotel is something you cannot do.
"I see no alternative but a term of actual imprisonment.".
Nichols was convicted and disqualified from driving for two years.
