The Workplaces (Protection from Protesters) Amendment Bill 2019 was tabled in Parliament last week and is expected to be debated in the House of Assembly next week.

The bill is a second attempt by the government to introduce this legislation after a first attempt was shot down by the High Court in 2017.

Protesters could face up to 18 months' jail under the new laws for a first offence and could face fines of up to $10,000 for individuals and $100,000 for a corporation.

Tasmanian Greens leader and petition sponsor Cassy O'Connor said the right to peaceful protest was a fundamental tenant of a democracy.

"It's a dog of a bill that attempts to patch up an act that was struck down by the High Court," Ms O'Connor said.

"We are launching a petition to give Tasmanians an opportunity to have a say and send a message to every member of the House of Assembly that they value the right to peaceful protest in this state and they won't stay silent while the Liberals try to turn Tasmania into a police state."

Leader of the House Michael Ferguson said the bill does not stop anyone speaking out or protesting on any matter.

"If passed, it would only apply to actions which affect or are intended to affect the lawful rights of others," Mr Ferguson said.

"An example of where this legislation would apply would be a protester who intentionally trespasses on a farm and intentionally impedes work.

"The bill seeks to implement the fundamental principle that, while people are free to protest, our laws should protect lawful business activities and their workers."

Labor deputy leader Michelle O'Byrne said Labor voted against the anti-protest laws the last time they were in Parliament and they would be voting no again.

"This legislation shows up a government hell-bent on limiting the voices of working people, and Tasmanians who call the Liberals out on their failures," Ms O'Byrne said.

"It's not about protecting workers - it's absolutely about silencing people who hold this government to account."

Civil Liberties Australia Tasmanian director Richard Griggs said the proposed laws were undemocratic and illiberal.

"They shield businesses from public criticism and elevate economic interests of organisations over the civil liberties and rights to free speech and assembly of individuals," Mr Griggs said.

"They are also unjust. They would impose harsh criminal and financial penalties on people who peaceful assemble on public land to protest."

Lawyer Roland Browne said the High Court first shot down the laws in 2017 because they were too broad, vague and difficult to enforce.

"They've extended it now to include thoroughfares. Also, they've introduced another offence of inciting somebody to interfere with business premises so that broadens it out further," Mr Browne said.

"There are plenty of laws on the statute books that cover every single instance of behavior that these laws appear to be aimed at - you have to wonder what the point of these laws is."

Former Australian Greens leader Bob Brown said the legislation was anti-Tasmanian.

"It will not deter people whose hearts are in our national and natural estates from defending them," Dr Brown said.

Equality Tasmania spokesman Rodney Croome said the proposed laws violate the democratic freedoms of all Tasmanians, including those who were still struggling against discrimination and prejudice such as LGBTIQ people.

"Should a company adopt discriminatory policies on sexual and gender minorities, everyday Tasmanians have an inalienable right to peacefully protest against those policies," Mr Croome said.

In a statement Unions Tasmania said the trade union movement was a movement built on protest.

"Workplace rights and conditions that many Australians take for granted today, including equal pay, superannuation and workplace safety laws, were won because the union movement protested for them," the statement said.

"These laws will capture legitimate union activity, like nurses protesting about safe staffing levels or workers who have had to stop work on site because their workplace was unsafe."
