The Tasmanian Electoral Commission scrutinised the almost 12,000 first-preference votes for Mr Bacon as part of a recount on Tuesday afternoon.
Ms Ogilvie won 4555 of those votes and former Labor candidates Tim Cox and Zelinda Sherlock won 4048 votes and 1634 votes respectively.
An exclusion process is now underway between the eight candidates who participated in the recount.

Two Greens candidates Aaron Benham and Mel Fitzpatrick are in the recount and Liberal candidate Kristy Johnson.
Mr Bacon resigned from Parliament last month after nine years of service.
Ms Ogilvie resigned from the party after she lost her seat in Parliament after the 2018 state election.
