Gavin Shaun Schuster appeared in the South Australian Supreme Court on Wednesday, where his lawyer asked Chief Justice Chris Kourakis to list the matter for a hearing.
The parole board and a psychiatrist may then be asked to give opinions on the transcript before a final decision on Schuster's release is made.
Schuster was jailed indefinitely in 2000 after a number of offences, including the 1999 sexual assault of a six-year-old girl inside a primary school toilet block.
In 2016, a Supreme Court Justice ordered he be released on strict conditions, but that decision was successfully appealed.
Previously, prosecutors said Schuster's latest bid for freedom should be considered under the state's new sentencing laws.
The rewritten rules establish a different test to be applied before offenders such as Schuster are freed.
They essentially require an individual to prove they are willing and able to control their sexual instincts rather than requiring the Crown to show they are unwilling or unable.
Schuster was on Wednesday remanded in custody to reappear before the court in November.
