UPDATE: Magistrate Simon Brown has dismissed the prosecution's case against Mr Phillips, because of concerns with identity. Mr Brown said that while he found an assault with indecent intent had occurred against the complainant, he was not satisfied to the requisite standard of proof that the man the complainant described was in fact the accused, Mr Phillips.

EARLIER: A LAUNCESTON man is contesting allegations he tried to grab a schoolgirl's breast in a KFC outlet last year.
Craig Andrew Phillips, 42, pleaded not guilty in the Launceston Magistrates Court today to one count of assault with indecent intent.
The complainant, a girl, 15, gave evidence that she was sitting in the Launceston CBD KFC outlet in June last year with two friends, also teenagers.
She told the court that a man came up to their table and started to engage in inappropriate conversation with them.
The girl said that the man later tried to reach for her breast with his hand, but she turned her body away.
A friend of the girl, who had been sitting at the table, also gave evidence for the prosecution.
