Cradle Mountain sexual assault appeal thrown out

A man who sexually assaulted his wife at Cradle Mountain in 2014 has lost an appeal to have his jail sentence reduced.

The appellant anally raped the complainant with a sex toy when she was unconscious, for which he was sentenced to 18 months in jail in April, 2017.

Justice Robert Pearce said the appellant’s guilty plea was given sufficient weight by the sentencing judge and so he dismissed the appeal.

Justice Pearce noted that the crime had caused the complainant significant “humiliation and indignity”.
