Jacob Christopher Austin-Stone blew .150 last year, a court heard.
In the Launceston Magistrates Court on Monday, he appealed an excessive drink driving notice and was successful.
Police did not oppose his application.
He has pleaded not guilty to a charge arising from the reading.
He will appear in court again on April 20.
