The court did not accept the argument of Solicitor-General Michael O’Farrell SC that trial judge Helen Wood had erred in ruling in March that the reasons for granting leases at Livingstone and Mount Lindsay should be provided to Save the Tarkine.
Chief Justice Alan Blow and Justices Stephen Estcourt and Michael Brett were unanimous the appeal should be dismissed, and ordered the state pay Save the Tarkine’s legal costs. In his judgment, Justice Estcourt found the appeal was without merit.
Save the Tarkine campaign coordinator Scott Jordan said the ruling was a decisive one. The group has sought the reasons for granting the Livingstone licence since 2012, when now Opposition Leader Bryan Green was Resources Minister, and the Mount Lindsay licence since 2014.
