Justice Robert Pearce ordered that the man be apprehended by police for failing to appear in court when requested.
The man is scheduled to play an integral role in the upcoming supreme court trial of Luke James Reader.
Crown prosecutor Peter Sherriff said he couldn’t prove that the witness did not have a reasonable excuse for no-showing his appearance.
But said the witness had not contacted the court.
