A LAUNCESTON morphine addict has been given another last chance after she breached a suspended sentence within months and will now serve a drug treatment order in lieu of eight months’ jail.

Toni Frances Leary, 29, had previously pleaded guilty to 17 new offences, including six breaches of bail, five counts of stealing, unlawful possession of property and three driving offences.
Her suspended sentence had been imposed for a raft of offences across 21 complaints.
Defence solicitor James Patmore told the Launceston Magistrates Court on Friday that his client would participate in the court-mandated drug diversion program.
Mr Patmore said Leary had been going through a difficult period when she gave evidence by video-link for a coronial inquest into a death in custody that occurred while an inmate was being transported to Launceston.
He said Leary had been in the van and found giving evidence about the incident ‘‘particularly hard’’.
Magistrate Simon Brown noted Leary was a mother of three, had no job, had a large number of outstanding fines and had hepatitis C linked to her very significant drug use.
‘‘Morphine has particularly been an issue for the last four years or so and the dishonesty matters before me arise out of you stealing to get money for drugs,’’ he told Leary.
‘‘You have a very, very large number of prior convictions ... for drug, dishonesty and driving matters.’’
Mr Brown said Leary had received community work, fines and wholly suspended imprisonment previously.
He said she breached the March 2014 wholly suspended sentence she received for driving and bail offences when she reoffended between May 2014 and January this year.
Mr Brown activated Leary’s three-month suspended sentence, cumulatively imposed five months’ jail for her new offences and made a drug treatment order.
‘‘You effectively have eight months’ jail hanging over your head,’’ Mr Brown said.
‘‘You can be affirmatively satisfied that this is your last chance.’’
He ordered Leary to face court again on September 18 at 2.15pm.
