Co-accused Adam Maxwell Cox, 35, of West Launceston and Mark Paul Phillips, 25, of Newstead, have pleaded not guilty to two counts of aggravated sexual assault, aggravated assault and two counts of criminal code assault.
In Launceston's Supreme Court this morning Justice Robert Pearce refused an application for preliminary proceedings, which would have seen the alleged victim cross-examined.
Justice Pearce said the exceptional circumstances that would warrant the man being cross-examined more than once did not exist.
He did not rule out the defendants' lawyers making another application for a preliminary proceeding once the indictment had been filed.
The matter was adjourned to a later date.
