TASMANIAN Director of Public Prosecutions Tim Ellis has appeared in court charged with one count of causing death by negligent driving.
Mr Ellis, 58, is alleged to be responsible for a crash that killed Launceston woman Natalia Pearn on the Midland Highway on March 24.
He has been on leave since then.
Mr Ellis shattered his leg in the crash and was still on crutches when he appeared before Chief Magistrate Michael Hill in Hobart yesterday.
His defence team objected to Mr Hill's indication that an interstate magistrate would hear the case because all Tasmanian magistrates had disqualified themselves.
Defence plans to argue the matter can be heard by one of five Hobart magistrates.
The case has been adjourned to November 11 before Mr Hill.
Mr Ellis will not be required to appear.
